"You" means the customer who use the Site and the products and services available through the Site;
“Order” means your purchase of goods or booking the products and services available through the Site;

Words imparting the singular shall include the plural and vice versa. Words imparting a gender shall include every gender and references to persons shall include an individual, company, corporation, firm or partnership.
Access to and use of the Site and the products and services available through this Site (collectively, the "Services") are subject to the following terms and conditions (these Terms and Conditions). By using the Services, you are agreeing to be bound by all of these Terms and Conditions, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to these Terms and Conditions. We reserve the right to amend these Terms and Conditions at any time. All amendments to these Terms and Conditions will be posted on-line. However, continued use of the Site will be deemed to constitute acceptance of the new Terms and Conditions.
Access to the Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason the Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of the Site.
While every effort is taken to ensure that all information advertised on the Site are accurate, errors may occur. All featured information on the Site (including, without limitation, prices , descriptions, features, shipping, cancel policy, and payment policy) are correct at the time first advertised on the onlyluxe.com.au website. All featured information on the Site is subject to changes without notice, and dependent on third party supply. The Site may also contains typographical errors or other errors or inaccuracies and may not be complete or current (hereinafter referred to as "these Errors”). We therefore reserve the right to correct these Errors and to change or update information at any time without notice. We reserve the right to cancel orders placed by you based on the Site that may contain these Errors.
These Terms and Conditions shall apply to all Orders made or to be made by us for the sale and supply of products or services. When you submit an Order to us, this shall in any event constitute your unqualified acceptance of these Terms and Conditions. Nothing in these Terms and Conditions affects your statutory rights (including the right to insist that products or services you buy from businesses must correspond with their description, be fit for their purpose and be of satisfactory quality).
These Terms and Conditions shall prevail over any other terms submitted by you in whatever form and at whatever time, in whatever formats (for examples: by phone, by email, in writing, but not limited to only those formats). No other changes to these Terms and Conditions shall be binding unless we agree in writing.
Terms of Sale
By placing an Order you are offering to purchase goods or booking products or services and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order. In order to contract with us you must be over 18 years of age and possess a valid credit or debit card issued by a bank, or possess a valid Paypal, Alipay, WeChat Pay, Apple Pay account, or your are the legal owner of any other payment methods acceptable to us. You must be fully entitled to use that card or account and the card or account must have sufficient funds to cover the proposed payment to us.
When you placing Order, you must follow our instructions on the Site. It is your responsibility to check all the information disclosed on the Site and during the checkout process. Your Order will summary the charges you must pay including GST, if applicable, and any applicable charges, including, without limitation, delivery charges and surcharges. Unless otherwise stipulated on the Site, all charges are in Australian currency. You shall complete your payment in full at the time of ordering by using any payment methods acceptable to us.
If your order is received by us and your payment is approved we will confirm you by email or SMS. We shall not be bound to supply products or services before we have received cleared funds in full. A contract between us for the purchase of products or services will not be formed until your payment has been approved by us. Where a contract is made with a third party, we are not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. We retains the right to refuse any request made by you, and we reserves the right to close your Onlyluxe Travel account at its sole discretion.
If you discover a mistake with your order after receiving our order of confirmation by email or SMS, we cannot guarantee that we will be able to amend your Order in accordance with your instructions. If there is any changes to your Order (including, without limitation, dates, prices, quantities) before we confirming your Order, we will try to contact you by email or SMS and ask you to confirm that you wish to proceed your Order with these modifications.
Once your order is received by us and your payment is approved, if your Order is related to goods, we will despatch your ordered goods at the place of delivery address requested by you in your Order. Delivery times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from the third party providers or force majeure for which we will not be responsible. We shall not be liable to your for any losses, costs, damages, charges or any other types of expenses resulting from the third party providers or force majeure for which we will not be responsible.
Once your order is received by us and your payment is approved, if your Order is related to booking (including, without limitation, accommodation, tours, experiences and boats), we will contact the third party providers and book your ordered products or services using the details requested by you in your Order (including, without limitation, check-in dates, departure dates, number of guests, name and ages). Bookings are subject to rules, restrictions and blackout dates for each product or service (see fine print of each product listing). Featured product pricing and availability are not guaranteed until the receipt of your booking confirmation email. We will confirm your bookings by email or SMS if the third party providers can fulfil all your order requests. If the third party providers cannot fulfil your order requests for any reasons, we reserve the right to modify your orders with your permission, or cancel your orders and process refund to you. We shall not be liable to your for any losses, costs, damages, charges or any other types of expenses resulting from the third party providers or force majeure for which we will not be responsible. Booking (including, without limitation, accommodation, tours, experiences and boats) is not transferrable to other guests.
Payment DetailAll pricing is in Australian dollars and are quoted on a per person twin share basis. A supplementary price is available (see below). Bookings are not confirmed until full payment and the signed Booking Form has been received by Onlyluxe Travel. A non-refundable 30% deposit is payable within 7 days of your booking, with the final balance due 60 days* prior to departure. If a booking is made 60 days or less before departure, the full payment is payable immediately. Last minute bookings are payable before arrival. Failure to pay on time may result in automatic cancellation of a booking with cancellation penalties payable to Onlyluxe Travel. If you pay by credit card or PayPal a surcharge will be added to the total price. *Some tours are required to be paid within different due dates. Please refer to product specific payment information at time of booking. Single SupplementAll accommodation is twin share. Single guests will share with someone of the same gender. If a single room is demanded, a supplementary price of will apply. The supplementary price refers to our quotation and needs to be stipulated at the time of booking.
Cancelation Policy
1. General
We may cancel your order (paid or unpaid order) if products or services are not available for any reason. We will notify you if this is the case and process refund to you if you have paid your order.
When paying with a combination of Onlyluxe Travel rewards points and the other payment method (i.e. credit card, cash), your order cannot be cancelled for refund or re-credit your reward points.
When you purchase products or services at discounted prices (not at full prices), your order cannot be cancelled.
2. Cancellation Policy for Travel and Tour Bookings
The following are general Cancellation Policy for bookings travel services and tours. Please see specific Cancellation Policy for products or services in each product listing. Specific Cancellation Policy for each product or service shall prevail over the general Cancellation Policy as below.
Please Note: Cancellations must be advised in email and will take effect from the date they are received.
Gift Card
Gift Cards will expire 24 months from date of issue shown on card. Gift Cards can only be redeemed with Onlyluxe Travel to book travel services offered by Onlyluxe Travel. Lost or stolen Gift Cards will not be replaced or refunded. Gift Cards are not redeemable for cash. A booking using Gift Cards is non-refundable. Any unused amount after the expire date of a Gift Card will not be refunded or credited. All other standard Terms and Conditions apply as detailed on our website, agreed to at the time of booking, including payment terms and cancellation terms from the tour operators and third party providers. We strongly recommend guests protect themselves with travel and medical insurance. We reserve the right to change these Terms and Conditions at any time.

LiabilityThe participant agrees to indemnify Onlyluxe Travel, and its servant, tour operator and agents, in relation to any liability, loss and damage which the tour operator, or its servants and/or agents may incur as a result of the participants, negligence or misconduct during the tour.

Changes to ItinerariesLocal conditions may necessitate changes to sightseeing, walking and driving routes, camping and accommodation locations. While every effort will be made to provide the services and experiences as offered in our brochure, on our website, and in our trip letters, we reserve the right to vary your itinerary. In the event that we are forced to change your arrangements, substitute arrangements of a similar standard will be provided. The tour operator will not be liable where interruptions to itineraries are caused by weather conditions, technical problems to transport used by the tour operator, industrial action, political or civil commotion or other circumstances beyond our control. We refer you to the conditions regarding travel insurance.Changes in PricesWhile we will do its utmost to honour its pricing unforeseen circumstances may mean that prices may be subject to change without notice.Pre-Existing Medical Conditions and Age LimitsYou need to advise Onlyluxe travel and the tour operator on any pre-existing medical condition, mobility impairment and/or disability that might reasonably be expected to increase the risk of your requiring medical attention, or that might affect the normal conduct of a trip and the enjoyment of other trip members. Onlyluxe Travel and the tour operator may require an assessment of your medical condition from a qualified medical practitioner. If you fail to adequately notify the tour operator of any pre-existing medical conditions and/or disability, the tour operator reserves the right, at its reasonable discretion, to cancel your participation in a trip at any time, including after the commencement of your trip, with no right of refund if your medical condition, mobility impairment and/or disability could be reasonably expected to affect the normal conduct of the trip and the enjoyment of other trip members.Cancellation by The Tour OperatorAll walks take place in very special wilderness settings. The operator is at the mercy of nature in all her beauty and all her fury. The operator will under no circumstance knowingly place at risk the health and well-being of the guests and guides. In the case of a Force Majeure Event (as defined below) we may need to cancel a walk with very little notice. In some cases, this can occur after the walk has commenced.If a walk does not meet minimum numbers, the operator reserves the right to cancel the departure; however, every effort will be made to consolidate numbers so that the booked walk will successfully depart.If the operator cancels a walk departure, the following options may be proivded:
Where a walk is cancelled by the operator, we will not be liable for any costs associated with travel to and from the designated walk departure pick up point. We therefore strongly recommend travel insurance to be taken out at time of booking.Force Majeure“Force Majeure Event” refers to an event(s) or circumstance(s) which includes, but is not limited to, acts of God, natural threats (such as bush fires, impassable snow and unsafe sea conditions), fire, earthquake, flood, windstorm or other extreme weather events, civil commotion, riot, blockade or embargo, breakdown, union dispute, epidemic, pandemic, lack or failure of courses of supply, passage of any law, order, regulation, ordinance, proclamation, demand, requisition or requirement or any act of any government authority, outside of the reasonable control of either parties whether or not foreseeable, which renders performance impossible; and “Recreational Services” means services that consist of participation in a sporting activity or a similar leisure-time pursuit; or any other activity that:
EvacuationsIn rare circumstances, due to injury or unforeseen illness, we may need to evacuate you from a remote part of the walk. Evacuation may be on foot (where the walker is physically capable) or by helicopter. Helicopter evacuations are expensive and, in most cases, will be at your cost. In addition to helicopter costs, any associated staff wages and ground transportation costs will be borne by you.For Australian residents, under the Australian Government Medicare Act, it is prohibited for any domestic travel insurance product to provide any financial reimbursement with regards to ambulance or air ambulance services. We therefore strongly recommend you to take specific ambulance cover through their health insurance provider.It is also strongly recommended that you take out travel insurance to cover (amongst other things) the costs associated with evacuation.
Indemnity FormYou are agree to sign an indemnity form by the tour oerator if it is requried. This form indemnifies the operator, its officers, directors, employees, servants, agents or consultants or any of them from and against all costs, claims, actions, demands and liability whatsoever and howsoever arising from or in any way connected with the tour booked by you (including any transportation to or from the area in which the tour is to take place) including such costs, claims, actions, demands or statutory duty or otherwise on the part of the company, its officers, directors, employees, servants, agent or consultants, and including any liability in respect of or related to your death, personal injury or loss of or damage to any property owned or possessed by you. Please refer to the terms and conditions outlined on the indemnity form.
Health and Fitness RequirementsYou must be in good health and must be fit in order to undertake the active tour booked by you. Some training or preparation work is generally required prior to departure. The more physically prepared you are, the more enjoyable your travel will be. The operator reserves the right in its absolute discretion to refuse a guest the right to participate in a trip on medical or fitness grounds.
Medical Forms and Doctors CertificatesIf you have a pre-existing medical condition, including allergies, you are required to disclose it at time of booking and may be required to supply a doctor’s certificate or complete a confidential medical questionnaire. If you are 69 years of age or older at the time of departure, you must supply a doctor’s certificate stating that you are in good physical condition and that you are no known ailments or pre-existing medical conditions likely to prevent them from completing the tour booked by you.
Travel InsuranceIn view of the heavy cancellation penalties applied to cancelled reservations in certain circumstances, we strongly recommends suitable travel insurance be purchased at the time the holding deposit is paid. We recommend insurance cover that covers any loss which may be suffered due to cancellation. We also strongly recommend comprehensive travel insurance against loss of baggage and medical expenses. Please note that we also strongly suggest that you take out travel insurance to cover the possibility of you having to cancel due to contracting COVID-19, or being a close contact of someone else who does. Our cancellation policy does not cover you for this eventuality, however many insurers do, and the policies are very reasonably priced.
JurisdictionThe law of New South Wales, Australia shall apply to these terms and conditions.
AcknowledgementBy placing a booking with us, you acknowledge and agree that we has relief on the representations made by you, including respect of your circumstances, travel insurance availability, age and medical condition which representations you hereby confirm and warrant are true, correct and complete in every respect.
